Terms of Use

Welcome to ASVPN. These Terms of Use ("Terms") govern your use of the ASVPN mobile application and related services (collectively, the "Service"). By downloading, installing, or using ASVPN, you agree to be bound by these Terms.

1. Service Description

ASVPN provides a virtual private network (VPN) service that encrypts your internet connection and routes your traffic through secure servers. The Service is designed to:

• Protect your online privacy and security
• Encrypt your internet traffic using the WireGuard protocol
• Secure your connection on public and untrusted networks

ASVPN is a privacy tool and is not intended to facilitate illegal activities or circumvent lawful restrictions.

2. Eligibility

To use ASVPN, you must:

• Be at least 13 years old (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By using ASVPN, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

Some features of ASVPN may require account registration. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Acceptable Use Policy and Prohibited Activities

ASVPN is designed to protect your privacy and security. You agree to use ASVPN only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.

4.1 Prohibited Activities

You are strictly prohibited from using the Service to:

• Criminal Activity: Engage in any activity that constitutes a criminal offense under applicable law, including but not limited to fraud, theft, money laundering, terrorism, or trafficking
• Hacking & Unauthorized Access: Attempt to gain unauthorized access to any computer systems, networks, or data; conduct penetration testing, port scanning, or vulnerability probing without authorization
• Malware Distribution: Create, transmit, or distribute viruses, worms, trojans, ransomware, spyware, or any other malicious software
• Network Attacks: Launch or participate in denial-of-service (DoS/DDoS) attacks, botnets, or any form of network-based attacks
• Spam & Phishing: Send unsolicited bulk emails, spam, phishing attempts, or fraudulent communications
• Child Exploitation: Access, distribute, or store any child sexual abuse material (CSAM) or content exploiting minors in any way
• Copyright Infringement: Infringe upon intellectual property rights, including unauthorized distribution of copyrighted content
• Harassment & Threats: Harass, stalk, threaten, defame, or abuse any individual or entity
• Identity Fraud: Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Illegal Content: Access, distribute, or store content that is illegal in your jurisdiction or the jurisdiction where our servers are located

4.2 Service Abuse

You must NOT:

• Interfere with, disrupt, or overload the Service, servers, or networks
• Attempt to bypass, circumvent, or disable any security features or usage limits
• Probe, scan, or test the vulnerability of the Service without authorization
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Resell, redistribute, sublicense, or commercially exploit the Service
• Share your account credentials or allow unauthorized access to your account
• Use automated systems (bots, scrapers) to access the Service in a manner that exceeds normal usage
• Use the Service in any way that could damage, disable, or impair our infrastructure

4.3 Compliance with Laws

You are solely responsible for ensuring your use of ASVPN complies with all applicable laws in your jurisdiction. The availability of the Service does not constitute permission or authorization to use it for any unlawful purpose. VPN usage may be restricted or prohibited in some jurisdictions; it is your responsibility to verify the legality of VPN usage in your location.

4.4 Reporting Violations

If you become aware of any violation of these Terms, please report it immediately to abuse@asvpn.app. We investigate all credible reports and take appropriate action.

5. Subscriptions and Payments

5.1 Subscription Plans

ASVPN may offer free and paid subscription plans. Paid subscriptions provide additional features and are processed through the Apple App Store.

5.2 Billing

All payments are processed by Apple through your App Store account. By subscribing, you authorize Apple to charge your designated payment method.

5.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings.

5.4 Refunds

Refunds are handled by Apple according to their refund policies. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

6. Intellectual Property

ASVPN and its contents, features, and functionality are owned by ASVPN and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the application
• Reverse engineer, decompile, or disassemble the software
• Remove any copyright or proprietary notices
• Use our trademarks without written permission

7. Third-Party Services

The Service may integrate with or link to third-party services (such as the Apple App Store). We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The Service will meet your specific requirements
• Any defects in the Service will be corrected
• The Service will be compatible with all devices or software

While we strive to provide reliable service, VPN connections may experience occasional interruptions, slowdowns, or failures due to factors beyond our control.

9. Limitation of Liability

9.1 Disclaimer of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASVPN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, including but not limited to:

• Loss of profits, revenue, or anticipated savings
• Loss of data, use, or goodwill
• Business interruption or loss of business opportunities
• Cost of procurement of substitute services
• Unauthorized access to, interception of, or alteration of your transmissions or data
• Personal injury or property damage arising from your use of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors, omissions, or inaccuracies in the Service
• Third-party conduct, content, or actions on the Service
• Any other matter relating to the Service

This limitation applies regardless of the legal theory under which damages are sought (contract, tort, negligence, strict liability, or otherwise), even if ASVPN has been advised of the possibility of such damages, and even if any limited remedy set forth herein is found to have failed its essential purpose.

9.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ASVPN AND ITS AFFILIATES FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:

• The amounts you have paid to ASVPN for the Service in the twelve (12) months immediately preceding the event giving rise to the claim; or
• One hundred US dollars (USD $100.00)

9.3 No Liability for Third-Party Actions

ASVPN is not responsible or liable for:

• Actions taken by third parties, including government agencies, ISPs, or hackers
• Content you access, transmit, or receive through the Service
• Any damage or loss caused by your reliance on information obtained through the Service
• Failures or interruptions caused by factors outside our reasonable control

9.4 VPN-Specific Disclaimers

You acknowledge and agree that:

• No Absolute Anonymity: While ASVPN enhances your privacy, no VPN can guarantee complete anonymity. Various factors (browser fingerprinting, cookies, account logins, DNS leaks, user behavior) may compromise privacy regardless of VPN usage
• No Security Guarantee: VPN encryption protects data in transit but cannot protect against malware on your device, phishing attacks, or security vulnerabilities in other software
• Connection Reliability: VPN connections may drop, fail, or experience latency. ASVPN is not liable for any exposure that occurs during connection failures
• Third-Party Services: ASVPN cannot protect you from data collection by websites and services you access while connected to the VPN
• Legal Compliance: ASVPN does not shield you from legal consequences of your actions. You remain fully responsible for your activities online

9.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, some or all of the above limitations may not apply to you, and you may have additional rights. In such cases, ASVPN's liability shall be limited to the fullest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless ASVPN and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

11. Service Modifications and Termination

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

11.2 Account Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

• You violate these Terms
• We are required to do so by law
• We reasonably believe your actions may cause harm to us or others

You may terminate your account at any time by discontinuing use of the Service and canceling any active subscriptions.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending notification through the app (for significant changes)

Continued use of ASVPN after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ASVPN regarding the Service and supersede all prior agreements and understandings.
